1. Notice 

The purpose of these terms with respect to the access and use of ICDL Connect is to inform you of: 

  1. Your obligations by which continued use by you is permitted by ICDL; and 

  1. the data relating to you that ICDL may collect and use (including disclosures to third parties) in connection with ICDL Connect.   

Please make sure you read these terms carefully and understand all details.  You should also familiarise yourself with the ICDL Connect Manual. 

  1. Your Obligations 

Use of ICDL Connect is subject to these Terms of Use. 

Only authorised users can access and use ICDL Connect.   

You must, at all times, maintain the confidentiality and security of ICDL Connect and any related information or data that is disclosed to you whilst being a registered user.   

You are entirely responsible for any and all use that occurs under your user details and for maintaining the security of your user details and the confidentiality and security of your username and password.   

You must not permit any other person to, access or use ICDL Connect using your registration details.  You should not share your registration details.  

You shall notify ICDL immediately if you know or suspect your access has been used by an unauthorised third party. 

You shall not:  

  • copy, modify or create derivative works from what is available on ICDL Connect;  

  • reverse engineer, disassemble, decompile, decode, adapt or otherwise attempt to derive or gain access to the Source Code of ICDL Connect, or any other software provided in connection with ICDL Connect or the ICDL Programmes, in whole or in part;  

  • bypass or breach any security device or protection used by ICDL Connect or access; 

  • use ICDL Connect, other than through the use of your own valid user access credentials;  

  • input, upload, transmit or otherwise provide to or through ICDL Connect any information or materials that are unlawful or injurious, or contain, transmit or activate any viruses or other harmful code;  

  • damage, destroy, disrupt, disable, impair, interfere with or otherwise impede or harm in any manner any software related to ICDL Connect, in whole or in part;  

  • access or use ICDL Connect in any manner or for any purpose that infringes, misappropriates or otherwise violates any intellectual property right or other right of any third party, or that violates any applicable law;  

  • introduce or permit the introduction of, any virus into ICDL Connect; or  

  • access or use ICDL Connect for the purposes of competitive analysis, the development, provision or use of a competing software, services or products, or any other purpose that is to ICDL’s detriment or commercial disadvantage. 

You may not use anyone else's user account at any time, without the express permission of the account holder. 

If you become aware of any activity prohibited under these Terms, please immediately notify ICDL of that activity.  ICDL shall take all reasonable and lawful measures that are necessary to stop the activity or threatened activity and to mitigate its effects (including, where applicable, by discontinuing and preventing any unauthorised access to ICDL Connect and permanently erasing and destroying any data related to any unauthorised access). 

You must be compliant with these obligations and you must not knowingly access, store, distribute or transmit any viruses, or any material during the course of use of ICDL Connect that: 

  • is unlawful, harmful, threatening, defamatory, obscene, infringing, harassing or racially or ethnically offensive; 

  • facilitates illegal activity; 

  • depicts sexually explicit images; 

  • promotes unlawful violence; 

  • is discriminatory based on race, gender, colour, religious belief, sexual orientation, disability; or 

  • is otherwise illegal or causes damage or injury to any person or property. 

ICDL reserves the right, without prejudice to any other rights, to disable your access to any material that breaches the provisions of this notice and advise your organisation that your user access has been disabled.  

You are expected to treat as confidential any information, data or details to which you have access under ICDL Connect and shall not disclose any related confidential information to a third party, unless required to do so by law.  

  1. Personal Data / information 

ICDL take our responsibilities under applicable data protection law very seriously.  Applicable data protection laws relate to the protection of individuals with regards to the processing of personal data, ICDL Foundation is bound by such laws and specifically (i) the General Data Protection Regulation (EU) 2016/679 (“GDPR”) from 25 May 2018; (ii) Directive 2002/58/EC (“ePrivacy Directive”) as implemented by EU Member States; (iii) any legislation that replaces or converts into domestic law the GDPR and/or the ePrivacy Directive (as may be updated or replaced); and/or (iv) any corresponding or equivalent national laws or regulations including any amendment, update, modification or re-enactment of such laws. 

ICDL is the controller of this personal data.  If you have any questions about our use of your personal data, please contact your ICDL regional operation.  

ICDL shall use personal data relating to you for the purposes of: 

  • Providing you with access to ICDL Connect 

  • Issuing notifications relating to usage and availability of ICDL Connect, including related updates 

  • To comply with any legal or regulatory obligations 

  • Engaging with you for the purposes of obtaining your feedback on ICDL Connect to inform and improve (where possible, personal data would be anonymised before being used for this purpose) 

The legal basis on which ICDL collect, process and transfer your information is: 

  • For the necessary performance of a contract with your organisation 

  • Our legitimate interests in ensuring the proper management and functioning of ICDL Connect as the online ordering platform and payment system for ICDL Certification Resources.   

  • Your express consent (see the section underneath regarding consent). 

  • ICDL will not process your personal data where to do so would constitute an unwarranted interference with your own interests, rights and freedoms.  

ICDL may disclose your personal data to other organisations in connection with the above purposes, including: 

  • To third parties who ICDL engage to provide services or benefits to ICDL or to you, such as professional advisors and outsourced service providers 

  • To competent regulatory authorities and other bodies as requested or required by law 

You have choices when it comes to the technology you use and the data you share. When ICDL ask you to provide personal data, you can decline. Many of our products require some personal data to provide you with a service. If you choose not to provide data required to provide you with a product or feature, you cannot use that product or feature. Likewise, where ICDL need to collect personal data by law or to enter into or carry out a contract with you, and you do not provide the data, ICDL will not be able to enter into the contract; or if this relates to an existing product you’re using, ICDL may have to suspend or cancel it. ICDL will notify you if this is the case at the time. Where providing the data is optional, and you choose not to share personal data, features like personalisation that use such data will not work for you. 

  1. Consent 

Consent to use and process your personal data was confirmed by you at time of registration for access to ICDL Connect, this included the following: 

  • Your name 

  • Your workplace details (name, address, phone number, email address) 

  • Your managers name 

  • Your username and password to access ICDL Connect 

  • Any information you provide in your interactions regarding ICDL Connect 

  • Any other personal data which you voluntarily provide to ICDL directly 

Consent to use and process your personal data can be withdrawn at any time by notice in writing to ICDL.  Please note that withdrawal of consent will ultimately result in the deletion of your personal data from our systems and shall also disable your username, password and access to ICDL Connect. 

  1. Requirement to provide data 

Your organisation has a contractual duty to provide ICDL with specific contacts in order to fulfil their obligations however you, as an individual, are not under any obligation nor do you have any statutory duty to provide ICDL with any personal data.   

ICDL cannot process your application where you do not provide ICDL with the required information in order to provide access.  Please refer to your manager in your organisation.  

  1. Retention of data 

ICDL will not hold your data for longer than is necessary.  ICDL may retain your personal data for the duration of your relationship with your “current” organisation and for such period of time thereafter as is necessary to comply with our legal and statutory obligations.   

Please notify ICDL if you leave your current role and/or organisation.  You are not permitted to provide another party with your username and password., as advised under section 2 above (Your Obligations), you are entirely responsible for any and all use that occurs under your user details.    

  1. Transfer of Data 

In connection with the above ICDL might transfer your personal data outside your jurisdiction.  If and to the extent that ICDL do so, ICDL will ensure that appropriate measures are in place to comply with our obligations under applicable data protection law governing such transfers.

  1. Your Rights 

You have the following rights, in certain circumstance and subject to certain restrictions, in relation to your personal data: 

  • Right to access the data – you can request a copy of the personal data ICDL hold about you, together with other information about or processing of that personal data 

  • Right to rectification – you have the right to request that any inaccurate data that is held about you be corrected, or if ICDL have incomplete information you may request that ICDL update the information and ensure it is complete  

  • Right to erasure – you have the right to request ICDL to delete personal data that ICDL hold about you.  This is sometimes referred to as the right to be forgotten 

  • Right to restriction of processing or to object to processing – you have the right to request that ICDL no longer process your personal data for particular purposes or to object to our processing of your personal data for particular purposes 

  • Right to data portability – you have the right to request ICDL to provide you, or a third party, with a copy of your personal data in a structured, commonly used machine-readable format 

  • Right to withdraw your consent – where our processing of your personal data is based on you having provided your consent, you have the right to withdraw such consent, at any time

  1. Complaints 

If you have any queries or complaints in connection with our processing of your personal data, please contact your ICDL regional operation.   

You also have the right to lodge a complaint with the Data Protection Regulator (or Commissioner) where they are available in your jurisdiction if you are not happy with the way ICDL have used your information or addressed your rights.   

  1. Intellectual Property and Copyright  

Intellectual Property means all intellectual property rights including rights in software and computer programs, copyrights, database rights, discoveries, concepts, domain names, patents, secret or other processes, technologies, know how, inventions, ideas, improvements, information, trade secrets, business methods, logos, documents, manuals, designs, trademarks, anywhere in the world existing now or in the future (whether any of the foregoing is registered or unregistered and including any application or right of application in relation to any of them). 

ICDL Connect and all Intellectual Property (including all the software in or accessible through ICDL Connect and the ‘look and feel’ of ICDL Connect and all parts of ICDL Connect, are the property of ICDL and/or third party licensors.   

You have no, and are not granted any, rights in or to ICDL Connect nor the Intellectual Property in ICDL Connect, other than the rights to use or access as expressly granted in these terms. 

You shall not remove from, tamper with or conceal any copyright, patent or trade mark insignia or statement on or within ICDL Connect. 

Please respect the Intellectual Property rights of ICDL and/or third party licensors when using ICDL Connect.

  1. General  

ICDL Connect may be unavailable from time to time, may be offered on a limited basis, or access may vary depending on your region.   

ICDL Connect is provided “as-is” and “as available". ICDL do not guarantee that ICDL are able to rectify all errors, faults or bugs. 

ICDL may change these terms if it is necessary due to (i) applicable law, including, but not limited to, a change of such law; (ii) an advice and/or order based on applicable law; (iii) the evolution of ICDL Connect; (iv) technical reasons; or (v) operational requirements.  ICDL shall use reasonable endeavours to inform you of the intended change before it takes effect, either through the user interface, in an email message or through other reasonable means.   

If you do not agree to the changed terms, you must stop using ICDL Connect.  Please also refer to section 3 above regarding your Consent.   

ICDL may change ICDL Connect or delete features or stop providing access to Third-Party Apps and Services in that respect at any time, including, without limitation, if our agreements with third parties no longer permit ICDL to make their material available, if it is no longer feasible for ICDL to provide it, the technology advances, or if customer feedback indicates a change is needed. ICDL will notify you in advance if a change to the Services will cause you to lose access to Your Content. For paid Services, ICDL will also notify you in advance of other material changes to the Services. Except to the extent required by applicable law, ICDL have no obligation to provide a re-download or replacement of any material, Digital Goods (defined in section 13(k)) or applications previously purchased. If ICDL cancel a paid Service, ICDL will refund to 

Any ICDL materials available for download through ICDL Connect are available solely for use in your (or your organisations) capacity as an ICDL partner and to the extent necessary to fulfil your role.  

  1. Cookies and other technologies 

Cookies are small text files placed on your device to store data that can be recalled by a web server in the domain that placed the cookie. ICDL use cookies and similar technologies for storing and honouring your preferences and settings, enabling you to sign in, combating fraud, analysing how our products perform and fulfilling other legitimate purposes.  

You have a variety of tools to control the data collected by cookies, web beacons, and similar technologies. For example, you can use controls in your internet browser to limit how the websites you visit are able to use cookies and to withdraw your consent by clearing or blocking cookies. 

Please see below for a list of cookies used by ICDL Connect (or third party licensors): 

ARRAffinity: Added automatically by Azure websites and ensures that requests are load balanced betICDLen different sites.  This does not store any user information. 

ASP.Net Session Id: Used to maintain the session of a logged in user to avoid repeated sign-in. The cookie is not persistent and is deleted after the session closes. 

Dynamics 365 Portal Analytics: Critical service cookie to analyze service usage anonymously and aggregated for statistical purpose. 

ContextLanguageCode: Stores the default language of the user accessing ICDL Connect within a session and across ICDLbpages. The cookie is deleted after session closes. 

.AspNet.ApplicationCookie: Used to identify user sessions. A user session starts when a user browses ICDL Connect for the first time.  This ends when the session is closed. Authentication site settings can be used to change session expiry time span. 

__RequestVerificationToken: Used by the antiforgery system. 

adxPreviewUnpublishedEntities: Holds preview ON/OFF mode used in classic Content Management Systems for portal/ICDL Connect administrators. 

adx-notification: Used in entity form actions to store alert message to be shown on redirection. 

timezoneCode: Holds the timezonecode field value of CRM timezonedefinition entity for the current timezone. 

timezoneoffset: Holds the timezone difference between UTC (Coordinated Universal Time) and Local browser time. 

isDSTSupport: Indicates whether a specified date and time falls in the range of daylight saving time. 

isDSTObserved: Stores a value to indicate if the current moment is in daylight saving time.
